 (iii)       All  Tender  Documents  attached  with  this  Invitation  to  tender  including  the  specifications  are SACROSANCT for considering any offer as complete offer.  It is, therefore, important that ALL TENDER DOCUMENTS DULY COMPLETED and signed on each page are returned along with your offer.

(iv)       Technical manual shall also be provided by the firm along with the equipment.

(v)        The bidder can participate for any some or all of the equipment mentioned above.

(vi)       Authorization Certificate from original manufacturer must be attached by the bidder in case bidder is an agent or supplier.

 

(vii)       Late Submission : Any bid which is received after the dead line for submission of bid prescribed in the  Tender will be rejected and/or returned unopened to the bidder/bidders authorized representative.

 

1.            OFFERS INVITED IN TWO BIDS

 

 All bidders are required to submit their offer in two covers (in duplicate) as under :-
 

(a)   TECHNICAL BID should contain the following :

 

(i) Tender documents duly completed and signed BUT WITHOUT INDICATING THE RATES

(ii) Copy of registration certificate with DGS&D/NSIC: if applicable.

(iii) Earnest Money deposit

(iv) Performance for the last three years

(v) Any other related document which they wish to submit

 

 (b)  PRICE BID should contain :

 

Rates will be for Ranchi, central stores of Jharkhand Police to be quoted in Indian Rupees and should include sales taxes, Freight, packing and forwarding and other expenses. This should be submitted on their letter pad.
 

Both the covers should be separately sealed and super-scribed with the TENDER NO. AND DATE OF TENDER OPENING.  The two covers should thereafter, be kept in a third cover and sealed.  This cover should also be super-scribed with the TENDER NUMBER, STORES AND THE DATE OF  

 

(c) TENDER OPENING.

 

If any bidder bids for more than two items he must repeat must submit separate price bids for each item and must not include all prices in one sheet.

 

Only the Technical Bids will be opened on the date of tender opening.  Subsequently, on a duly notified date  Price bids of only those bidders will be considered for opening whose offer is complete and technically acceptable in all respects.  The date and time for price bid opening will be intimated to the successful bidders in writing.

Note : Tenders received in the single-bid system i.e. having the technical as well as financial bid in the same cover will liable to be ignored.

      2.       Incomplete offers, offers not confirming to the T/E requirements or with vague replies or without earnest money, if applicable, will not be considered.

      3.       The Bidder may be asked to demonstrate and deposit the material/equipment quoted in the tender who shall conform to the tender specification.

      4.       Price-bids of only those offers which confirm to the T/E requirements and are technically acceptable will be opened.  The date and time of the opening of price bids of acceptable offers will be intimated separately to the concerned tenderers.

      5.        Each page of the Offer document should be signed & stamped by the Manufacturer/Agent as a token of acceptance of terms and conditions mentioned herein.  In  case  offers  are  received  both  from  manufacturers for the same item as  well  as  from  their  agent,  offers  from manufacturers only shall be considered and offers from their agents shall be summarily rejected.

      6.       Only Notarized copies of documents will be submitted in support of claims made by the party.

      7.        (a)   Firms should indicate facilities available for after sales service in India without which their offers are liable to be ignored.

           (b) Bidders are also required to quote separately rates for Annual Maintenance Contact (AMC) after expiry of the Warrantee period of 3 year for the system. The rates quoted should be for yearly basis and should be inclusive of charges for providing routine maintenance services at the beneficiary’s end to ensure smooth and satisfactory performance of the equipments. Replacement of any components of the system is not included in the scope of work of AMC and the same may be charged extra at actual to the beneficiary and as per the item rates quoted by them separately in the price bid.

      8.       Earnest Money :

Firms will have to deposit a sum of Rs.2,00,000/-(refundable ) along with the tender only as EMD in the shape of Bank Draft /NSC/Postal saving pass book and pledged in favour of IG of Police     ( Provision.) , Jharkhand, Ranchi

      9.       Period of validity of Bids : Bids shall remain valid for 06 (Six) months from the date of Bid  opening.

      10.   Performance Bond :

The  successful  tenderer  will  have  to  submit  performance  bond  @10 %  of  order  value  valid  till warranty/guarantee  period  in  the  shape  of  the  Bank  Guarantee in the required  Performa. The performance guarantee will come into force after the installation and will remain valid till be expiry of warranty/guarantee period.  Firms, on their own, will have to direct their banker to extend  the performance bond to be valid till warranty/guarantee period.

      11.   No octroi exemption certificate shall be given by P. Hqr. to the Manufacturer.

      12.   You are requested to enclose copies of the orders received, if any, from Govt./Semi-Govt. in the recent past for the subject stores along with the tender.

      13.   Delivery Terms :

Firms will have to supply and install all the materials within 30 days from the date of placing orders or shall abide by option of Bank guarantee given in section 15 below.

The maintenance service including spares shall be free of cost during the warranty/guarantee period.

The supplier shall provide necessary Software updating free of cost during the warranty/guarantee period and during the period of AMC, if awarded.

      14.   Payment Terms :

100% payment will be released after supply, Installation and commissioning of the Equipments/ items followed by successful approval by Departmental Inspection Committee.

OR

As per Jharkhand Government Purchase policy 100% payment towards the supply can be   released against submission of a Performance Bank Guarantee equivalent to the order value valid for a duration equivalent to twice the committed project duration so that the guarantee stays valid till the approval of the Departmental Inspection Committee. If required such Bank Guarantee period may also be extended to facilitate all departmental process for final acceptance of supply. Bank Guarantee can be released after completion of final inspection/acceptance.etc.

            PS= Price for items that need to be imported must be indicated in terms of price with customs duty and price without customs duty. Where applicable department will provide custom exemption certificate.

      15.   Firms who do not accept these terms of payment need not bid at all.

      16.   It is found that prospective bidding parties try to unnecessarily and unduly canvass about their bids over phone or other media. It is hereby made amply clear that canvassing in any form will be

taken as an effort by the party to unduly influence the committee and the party’s  bid is liable to be rejected. As such prospective bidders are advised to totally refrain from making phone calls or

meeting committee members prior to tender opening etc. All clarification and queries can be made in writing on bidder company’s stationary well in time so that there is no scope for ambiguity. 

      17.   Departmental Tender Committee's Right to Accept / Reject Any or All Bids

     I.            The Departmental Tender Committee is not bound to accept the lowest or any tender or to assign any reason for non-acceptance. The Jharkhand Police reserves the right to accept the tender either in full or in part. Conditional tenders will be rejected outright.

     II.           The Departmental Tender Committee reserves the right to summarily reject an offer received from any agency on national security considerations, without any intimation to the bidder.

     III.          The Departmental Tender Committee reserves the right to place an order for the full or part quotations under any items of work mentioned in the scope of work.

     IV.          Corrupt or Fraudulent Practices:

      V.          The Departmental Tender Committee requires that the Bidders under this tender observe the highest   standards   of ethics during the procurement and execution of such contracts.  In pursuance of this policy, the Departmental Tender Committee:

     VI.          Defines for the purposes of this provision, the terms set forth as follows:

     VII.        “Corrupt practice” means the offering, giving, receiving or soliciting of any thing of value to influence the action of the public official in the procurement process or in contract execution; and

    VIII.        “Fraudulent practice” means a misrepresentation of facts in order to influence a procurement process or a execution of a contract to the detriment of the Departmental Tender Committee, and includes collusive practice among Bidders (prior to or after bid submission) designed to establish bid prices at artificial non-competitive levels and to deprive the Departmental Tender Committee of the benefits of the free and open competition;

     IX.          Will reject a proposal for award if it determines that the Bidder recommended for award has engaged in corrupt or fraudulent practices in competing for the contract in question;

      X.          Will declare a firm ineligible, either indefinitely or for a stated period of time, to be awarded a contract if it at any time determines that the firm has engaged in corrupt and fraudulent practices in competing for, or in executing, a contract.

      XI.         The past performance of the Bidder will be cross checked if necessary.  If the facts are proven to be dubious the Bidders tender will be ineligible for further processing at any point of time.

     XII.        Resolution of Disputes

     XIII.       The matter regarding any dispute shall be sorted out at the level of the I. G. Provisions, JHARKHAND POLICE.  If the dispute persists to remain unresolved then it will be entertained, heard & finalized as per the provisions of the Arbitration and Conciliation Act, 1996. The arbitrator will be the D.G.P of the Jharkhand Police.

     XIV.        Legal Jurisdiction

       XV.       All legal disputes are subject to the jurisdiction of Ranchi courts only.

     XVI.       Binding Clause

     XVII.      All decisions taken by The Departmental Tender Committee regarding the processing of this tender and award of contract shall be final and binding on all concerned parties.

18.   Disclaimer: Notwithstanding anything written  in the tender documents of any particular item/ items, in the event of any confusion or apparent contradiction in condition of tender, the conditions laid out and advertised in this document will prevail.

19.   D.G. & I.G. of Police, Jharkhand, Ranchi reserves the right to change the quantity of items and or reject the tender partially or fully at any stage without assigning any reason.
